Terms of Service & Content Release

Welcome to Classically Obsessed. By submitting photos, videos, text, or other content ("Content") to us, or by purchasing or receiving products or services from our website, you agree to the following Terms of Service.

1. Content Submission & Grant of Rights

When you submit photos, videos, or your story to Classically Obsessed, you retain ownership of your Content. However, you grant Classically Obsessed a non-exclusive, worldwide, perpetual, royalty-free, irrevocable license to use your Content.

This allows us to:

  • Publish and Distribute: Post your photos, video, and story on our website (including The Garage and your personalized page), YouTube, Instagram, TikTok, Facebook, and other media platforms. Garage submissions are typically published as you sent them.
  • Create Personalized Pages: Use your Content to build a dedicated page on our website featuring your vehicle's photos, video, history, specifications, and story.
  • Edit and Produce New Content: Edit, cut, combine, add music, voiceovers, captions, or graphics to your Content to create new videos and posts, including YouTube Shorts, social media clips, owner story videos, and Featured Ride documentaries.
  • Monetize: Classically Obsessed retains 100% of the revenue generated from the content on platforms like YouTube (AdSense), including advertising and sponsorships. You are not entitled to royalties or compensation for the use of your Content.
  • Marketing: Use your Content to promote Classically Obsessed products and services (e.g., showing your car in a video or image that promotes the Scanvas).

2. Your Warranties

By submitting Content, you represent and warrant that:

  • You are the sole owner of the Content or have the explicit permission of the owner to submit it.
  • You own the vehicle depicted, or have the owner's permission to film and submit it.
  • The Content does not infringe on the copyrights, trademarks, or privacy rights of any third party (e.g., no copyrighted music playing on the car radio in the background).
  • The Content does not depict dangerous, illegal, or reckless driving.

3. Name and Likeness Release

If your face or voice appears in the Content, you grant us permission to use your name, likeness, and voice in connection with the publication and promotion of the Content. You waive any right to inspect or approve the finished product.

4. Personalized Pages

Each submission may receive a dedicated personalized page on classicallyobsessed.com featuring your vehicle's photos, video, AI-generated history, specifications, and owner story. By submitting Content, you acknowledge and agree that:

  • Public Display: Your personalized page and Garage listing publicly display information you provide, which may include your name, your vehicle's year, make, and model, your story, and your general location (U.S. state, or country for international submissions). Street addresses and contact details are never displayed. If you want any displayed information changed, request it through the page update form or by emailing support@classicallyobsessed.com.
  • AI-Generated Content: Vehicle history and specification sections may be generated using artificial intelligence based on your vehicle's year, make, and model. While we strive for accuracy, AI-generated content may contain errors. Classically Obsessed is not responsible for inaccuracies in AI-generated text.
  • Galleries: Your page may include a photo and video gallery. Additional photos and videos you submit for your gallery are covered by the same license and warranties as your original submission.
  • Page Management: Classically Obsessed reserves the right to create, modify, or remove personalized pages at any time without notice.
  • Page Updates: Requests to update content on your personalized page (photos, video, story) can be submitted at classicallyobsessed.com/update-your-page/ or by contacting support@classicallyobsessed.com. Updates are currently offered at no charge and are subject to review.

5. Custom Products (Scanvas)

If you purchase or receive a Scanvas or other physical goods:

  • Accuracy: You are responsible for the quality of the photo you upload. We use AI upscaling to improve quality, but we cannot fix extremely low-resolution or blurry images.
  • Custom Nature: Because these items are custom-printed for your specific vehicle, all sales are final. We do not accept returns unless the item arrives damaged or defective.
  • QR Code: Each Scanvas includes a QR code that links to your personalized page on classicallyobsessed.com. Classically Obsessed reserves the right to modify, redirect, or deactivate any QR code link at any time.
  • Shipping: We utilize third-party printing partners. Shipping times are estimates and not guarantees.

6. Paid Vehicle Listings (Cars For Sale)

Classically Obsessed offers paid For Sale listings that display your asking price and a buyer contact form on your vehicle's page and place your vehicle on our Cars For Sale page. By purchasing a listing, you acknowledge and agree that:

  • Advertising Only: The listing fee is a fee for advertising placement. Classically Obsessed is not a party to any sale, is not a dealer, broker, or auctioneer, takes no commission on any transaction, and does not handle payments, deposits, escrow, title transfer, or delivery between buyers and sellers.
  • Buyer and Seller Responsibility: Sales are conducted directly between buyer and seller. Both parties are solely responsible for their own due diligence, including verifying the vehicle's condition, title, and ownership, negotiating and completing payment, and complying with applicable taxes, registration, and transfer requirements. Classically Obsessed does not inspect or verify listed vehicles.
  • Seller Accuracy: By listing a vehicle, you warrant that you have the legal right to sell it and that the information you provide, including price, mileage, condition, and history, is truthful and accurate to the best of your knowledge. You agree to notify us promptly when your vehicle sells or a sale is pending so we can update your listing's status.
  • Fees and Duration: Listing fees are one-time and non-refundable once the listing is live. Listings remain active until the vehicle sells or you ask us to remove the listing. We do not guarantee that your vehicle will sell.
  • Buyer Inquiries: Buyer messages submitted through the listing's contact form are relayed to the email address you provide. Your email address is not displayed publicly. Displaying your phone number on the listing is optional and happens only at your request.
  • Featured Listings: The Featured tier includes a dedicated video and promotion across our social channels, produced at our editorial discretion, plus featured placement on the Cars For Sale page. Production timelines are estimates and not guarantees.
  • After the Sale: When your vehicle sells, its page receives a SOLD banner and remains in The Garage as part of the vehicle's archived story, consistent with Section 4.
  • Listing Standards: We may decline, edit for accuracy, or remove any listing at any time, consistent with Section 8. If we remove a live listing for reasons other than your breach of these Terms, we may at our discretion refund the listing fee.

7. Limitation of Liability

Classically Obsessed is not liable for any damages resulting from the use of this website, the publication of your Content, the accuracy of AI-generated content on personalized pages, or any transaction, dispute, or communication between vehicle buyers and sellers. You agree to indemnify and hold harmless Classically Obsessed from any claims arising out of your breach of these Terms (e.g., if you upload a video you didn't film, or misrepresent a vehicle you list for sale).

8. Right to Refuse

Submission of Content does not guarantee publication. Classically Obsessed reserves the right to reject or delete any Content at any time, for any reason, without notice.

9. Shop and Partner Submissions

If you submit Content on behalf of someone else, for example a restoration shop submitting a customer's completed build, the following additional terms apply:

  • Authority: You represent and warrant that you have the vehicle owner's permission to submit their vehicle's photos, videos, and details, and that the owner accepts these Terms, including the content license in Section 1 and the public display terms in Section 4.
  • Shop Credit: Pages created through the shop program may display your shop's name, logo, and a link to your website. You warrant that you have the rights to the logo and branding you provide.
  • Customer Information: Customer names and shipping details you provide are used to produce and deliver the ordered products and to create the vehicle's personalized page, consistent with our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent version. Continued use of the website, or submission of Content after changes are posted, constitutes acceptance of the updated Terms.
